Although with all the ‘Aishwarya Rai Bachchan’s’ and ‘Kareena Kapoor Khan’s’, young brides prefer to also keep their maiden name after marriage instead of completely giving up their identity. Although, a single signature across your new name on your wedding certificate does not make your legally Mrs XYZ. You have to follow a couple of time-consuming but relatively easy task to make your new name official.

Affidavit Submission for Name Change

Your first step to the name change procedure is to prepare an affidavit with the help of a notary. The notary will suggest the stamp paper of the required value on which the name change affidavit after marriage is made. You’ll have to submit information like your name and the new name, current address and your reason to change the name (Marriage, astrology, numerology, etc). Women changing their name for marriage will have to also provide their old name with father’s name and address, the new name with husbands name and address and marriage date.

Once the stamp paper is ready you’ll need signatures of 2 witnesses. These witnesses have to be two persons of the gazetted officer rank, and along with their signature, you’ll need it attested with their stamp. The name change affidavit has to reflect both your old and new name. Affidavits can be used for changing the whole name, surname or just a few letters. Keep a copy of the name change affidavit as this is a crucial document and will be of use for future legal formalities.

For overseas Indians, who would like to change their name, one needs to submit a deed stating the change of name, duly signed by the Indian High Commission office or the Indian Embassy.

Newspaper Publication for Name Change

The next step is to make it official by posting an advertisement/notification on two popular daily local newspapers. One of the newspaper has to be of the official language of the state and the other in an English publication. For example, if you reside in Maharashtra one of the newspapers can to be Lokmat and the other can be The Times of India/Hindustan Times.

The information needs to make this advertisement is your old name, your new name, your address and your date of birth along with documents like affidavit copy. Married women, who would like to change their surname after marriage, should add their husband’s name and address in the notification.

Once the notification is published, save as many copies as you can. This notification can be used as legal proof in the future.

Name Change in Gazette After Marriage

One more step and you’re done, you can officially be Mrs XYZ. All you need to do is complete the name change after marriage gazette procedure, and your name change procedure will be legally complete. A notification of name change in gazette after marriage is mandatory for government officials and optional for others. Although the notification of the name change in gazette after marriage is a substantial proof of your name change. As this process is really short and just requires submission of a few documents, it makes sense to go through with it.

Here is what you need to do to submit the notification of name change in gazette after marriage in Mumbai:

  1. A copy of the ‘Deed changing name form’ available with the Controller of Publication, Department of Publication
  2. A letter of declaration from you is also needed that states the need for changing the name
  3. Original copies of both the newspaper advertisements published with the date.
  4. Two attested photographs
  5. Address and identity proofs (The address should be the same as the one published in the newspaper and affidavit. Any change of address might result in rejection of application).

Call the Controller’s office of Publication to get a detailed information of everything that is needed, before sending in the following details. The office of the Controller of Publication will send the information, with the necessary copies of the Gazette on which the Advertisement/Notification has appeared. The Government will print the change of your name in the Gazette.

The amount charged for Gazette notifications varies –- either Rs. 700 or Rs. 900 –- depending on whether you want a public notice or not. The money can be paid either in cash or by a demand draft/postal order drawn in favour of’ the Controller of Publication from your respective state. You can submit it in person or you can courier/speed post the envelope.

All the above documents can be used to officially change your name in bank records, PAN cards name change, renewal of passport, and any other documents deemed necessary.

PAN Card Name Change After Marriage

You can apply for a PAN card name change after marriage, through the online portal. For the PAN card name change procedure the Form ‘Request for renewal of PAN card’ needs to be filled for previous PAN card holders and Form 49A needs to be filled by the applicant who is applying for the PAN card for the first time.

For performing the PAN card name change after marriage procedure online, you can apply through the Tax Information Network (TIN) or National Securities Depository Limited (NSDL) website. Once the application is accepted, a PAN acknowledgement number will be issued with the PAN details and correction requests. The signed acknowledgement form affixed with your (signed) photograph, demand draft, proof of existing PAN, date of birth proof, identity proof, and address proof must be sent to NSDL e-Governance Infrastructure Limited.

The fee for PAN card name change after marriage procedure is Rs.110 for contact address within India and Rs.1,020 for contact address outside India. For communications outside India, fee payment can be made via credit card, debit card or Demand Draft payable at Mumbai drawn in favour of ‘NSDL – PAN’.

Process for Passport Name Change After Marriage

If you wish to make a passport name change after marriage, you will have to apply for a Re-issue’ of the Passport and download or avail Form No. II for Miscellaneous Services either online or from the Passport Seva Kendra. Fill the passport name changing form and submit it online or at the Seva Kendra along with the documents required and the nominal fee. The documents needed for the passport name change procedure from maiden to married are, the notarized affidavit, notarized copy of the first and last page of the spouse’s passport and notarized copy of the marriage certificate.
